General Terms and Conditions for the Online Store
The general terms and conditions of the Apis M&D online store are composed in accordance with the Consumer Protection Act (ZVPot), the recommendations of the Chamber of Commerce and Industry of Slovenia and international e-business codes.
We advise you to read the below Terms and Conditions carefully before using the online store. By using the apis-md.si website you agree with the Terms and Conditions. If you do not agree with the Terms and Conditions, you should not use the Apis M&D online store. APIS M&D d.o.o. reserves the right to change the Terms & Conditions of the top-service website at any time. All changes are binding for the customer, so we recommend that you regularly check the Terms and Conditions.
The APIS M&D online store is an information system, intended for the presentation and sale of products to the user. It is managed by APIS M&D, hereinafter referred to as the provider. The user is a person using our system, i.e. a buyer in the online store. Upon registration at the online store the visitor receives a username, which is the same as the user’s e-mail address determined by the user in their profile, and a password. The username and the password unambiguously determine the user and connect them with the filled-in data. After registration the visitor becomes a user and gains the right to purchase products. The General Terms and Conditions deal with the operation of the APIS M&D online store, user rights and the business relationship between the provider and the buyer.
Information Accessibility (Legislation Summary)
The provider undertakes to always provide the following data to the buyer:
a) Identity of the company (name and headquarters, registration number)
b) Contact addresses, enabling fast and efficient communication (e-mail, phone)
C) The essential characteristics of the goods or services (including after-sales services and warranties)
D) Accessibility of products (each product or service offered on the website should be accessible in reasonable time)
E) Delivery or service execution conditions (manner, place and date of delivery)
F) All prices must be clearly and unambiguously determined and it must be evident whether they already include taxes and transport costs
G) Payment and delivery methods
H) Offer validity
I) Deadline within which it is possible to withdraw from the contract, as well as the conditions of withdrawal; and also the information about the cost of product return
J) The complaint procedure must be clarified, including all contact data of the responsible person or customer service
The provider undertakes to always provide the following information to the buyer: the identity of the company, contact addresses, key characteristics of the goods or services, product accessibility, delivery or service performance terms and conditions, all prices clearly and unambiguously determined, payment and delivery method, offer validity, deadline for possible withdrawal from the contract and the terms of withdrawal as well as the complaint procedure, including all contact data of the responsible person or customer service.
The Apis M&D online store currently enables advance payment and payment upon delivery. If you choose payment upon delivery, the post employee collects the payment for the goods, the postal charge (for purchases of up to €100 the postal charge amounts to €4.50 including VAT) and the billing fee (according to the price list of Pošta Slovenije) in cash upon delivery or acceptance. The costs of the packaging are covered by Apis M&D. For purchases above €190 the postal charge is paid by Apis M&D d.o.o.
We do not recommend you perform payment immediately after receiving the informative summary of the purchase, since we cannot ensure that the paid goods will be delivered in the desired deadline. You should wait until you receive precise information about our stock and the delivery date.
The provider issues an invoice to the buyer on a durable medium, with clarified costs and instructions on how to withdraw from the purchase and return the goods, if this is necessary and possible.
The sales contract (order) is saved in electronic form on the provider’s server and accessible to the buyer at any time in their user profile (My profile).
The prices quoted in the online store are irrevocable and only apply to online orders, so there can be price deviations in online stores and other stores across Slovenia for individual products. The prices only apply for the above-mentioned payment methods under the above-mentioned terms and conditions. All prices include VAT, unless expressly specified otherwise. Despite our efforts to always provide the most up-to-date and accurate information, the price information can sometimes be inaccurate. In that case, or if the product price changes during the processing of the order, the provider will enable the buyer to withdraw from the purchase, while at the same time offer a satisfying solution for both. If the product is not in stock, the price can change, and the provider must inform the buyer about this. The pictures may only be symbolic and do not always completely depict the actual state.
Special offer validity
The special offer validity dates are stated in the special offer and can differ.
1. Order received After submitting the order, the buyer receives a notification by e-mail that the order has been received. At this point, the buyer can revoke the order within one hour. The buyer can always access comprehensive data on the status and content of the order. The minimum value of the online order is 15 euros.
2. Order confirmed If the buyer does not revoke the order, it is further processed. The provider reviews the order, checks the availability of the ordered products and confirms or justifiably rejects the order. To check the data or ensure accuracy of the delivery, the provider can contact the buyer by phone. When delivering goods that are not in stock at the provider’s warehouse, the provider is bound solely by the delivery of its supplier and the deadline in which the supplier can deliver the goods to the provider. The provider regularly informs the buyer by e-mail about the newest information regarding the delivery of the goods. If the delivery deadline is very long and the buyer does not want to wait, the buyer can inform the provider about this and the provider removes the product from the order and returns the potentially paid resources. The buyer then decides whether the remaining products from the order get supplied or whether the entire order gets cancelled. The provider does not assume any liability for damage arising due to longer delivery deadlines or non-delivery of the goods the provider does not have in stock at their own warehouse.
3. Goods shipped The provider prepares the goods in the agreed deadline, ships it and notifies the buyer about this by e-mail. In the e-mail the provider also informs the buyer about the return policy and about who to contact in case of a delivery delay or a complaint.
Right to withdraw from the purchase, return of goods
The buyer has the right to return the paid goods without any compensation payment. The buyer must inform the provider by e-mail (email@example.com) or by regular post with registered shipment about the intended return. This must be done within 15 days from the acceptance of the goods. The deadline for the return of the goods is 30 days after the confirmation of the receipt of the notification about the intended return of the goods. The returned products must be unused, undamaged, packed in the original packaging and they must also be in the original quantity. The receipt must be enclosed. All costs connected to the return of the goods are assumed by the buyer returning the goods. Apis M&D d.o.o. is not obliged to accept any deliveries against payment or deliveries that are not pursuant to the general terms and conditions.
Apis M&D d.o.o. will return your payment or exchange the product within 30 days after the acceptance of the returned goods.
The products are under warranty if this is stated on the receipt you receive upon purchase. The warranty is valid if the instructions on the warranty certificate are complied with, and with a valid receipt. The warranty period is stated on the warranty certificate or on the receipt.
If no warranty information is given, the product does not have a warranty or the information is unknown at this moment. In the latter case the buyer can contact the provider, who will ensure an up-to-date information.
The delivery deadlines are stated as the number of working days. The delivery deadline for products in stock is 3–7 days.
The provider must deliver the goods within the agreed deadline. The contracting partner for the delivery of goods is Pošta Slovenije, but the provider reserves the right to contract a different delivery service, if the order is fulfilled more efficiently that way.
Delivery is performed during the week until 4pm (delivery by Pošta Slovenije) to the address stated at the submission of the order. If you want to add an additional delivery address, enter it in the optional field of the order form. If your chosen payment method is cash payment upon delivery, make sure the recipient of the delivery has enough cash on hand to pay for the delivery. In some cases delivery outside of the working hours of the delivery service, a delivery at the agreed time or express delivery is also possible. You can discuss these options with the Apis M&D sales representative, and the cost of the agreed special deliveries can differ from the above conditions of regular delivery.
If you are not home at the time of the delivery, the Pošta Slovenije courier/deliverer will leave a notice based on which you will agree on new delivery or acceptance. If the goods are delivered by Pošta Slovenije, they are waiting for you at the nearest post office.
The provider uses appropriate technological and organisational means for the protection of the transfer and the storage of personal data, orders and payments.
Right to privacy
The provider undertakes to protect all personal data in accordance with the Data Protection Act (Official Gazette of the Republic of Slovenia, No. 86/2004) and the Insurance Act. All data obtained through the www.apis-md.si website will be used exclusively for sending information materials, offers, invoices and other necessary communication.
Electronic advertising messages must be clearly and unambiguously marked as advertisements. The sender must be clearly evident. The provider will unconditionally respect the user’s wish not to receive advertising messages.
The provider shall ensure promptness and accuracy of the data, published on their websites. Nevertheless, the characteristics of the products, their availability and price can change so quickly that the provider cannot correct the data on the websites in due time. In this case the provider notifies the buyer about the changes and gives the buyer the option to cancel the order or exchange the ordered product. All pictures are symbolic and do not guarantee the quality of the product. We accept no responsibility for typing errors.
